Westbrook home An attorney representing the hospital’s insurance company has come offering Drea a check for $15,000. He is urging her to sign, telling her that they are trying to clear things up as quickly as they can to spare the families any more grief.
James arrives, and hearing the pitch, tells Drea not to sign. The insurance attorney asks if James is a lawyer (James doesn’t reply). When James again encourages Drea not to sign, but to wait, the insurance attorney wants James’ name for his records. Drea tells the guy she needs some time to think about it.
After the insurance attorney leaves, James explains to her that what the hospital is trying to do is get her to sign papers saying that she waives her rights to sue over her husband’s death.

Yuk. Law clerk stuff. Sounds very familiar. Annie - try finding and downloading CrazyBrowser. Its a great wrap around for IE and turns each page you open into a tab. On top of that it has popup stopper which works perfectly in the background. And you can set up a whole heap of pages to open all at the same time, as a group. Very handy for this site.

Hallway at the courthouse Nick is walking through the hallway with his usual brisk, purposeful stride. James joins him, saying he needs to talk for a moment. James tells Nick that he has filed suit against the hospital, to which Nick replies, “You’re fired.” James, clearly expecting this, offers an envelope and says “Then you won’t be needing this.” “Your resignation?” asks Nick. He accepts the resignation letter, saying it works better this way. Nick continues on to the courtroom.

Outside the Courtroom Laurie introduces the boy, Josh. Nick chats with Josh for a few moments before they go in. It is painfully clear that he is desperate to impress potential adoptive parents, as he tells Nick that at the last one he messed up by not telling a man that had season tickets to the Penguins’ hockey games that he is a big fan of ice hockey. Nick says, “So you like hockey,” clearly trying to get to know the child a little better so he can make a better plea. Josh replies, “No.”
Obviously what James was expecting, but I don't blame Nick. James has an clear and obvious conflict of interest and shouldn't work for F&F if he is going to continue to act in this manner.
Nevertheless, Nick isn't going to be Mr Popular at F&F with all of this going on.
And the poor little orphan kid. Turning himself inside out just to get a bit of love.

Attorney’s office James goes to see another attorney he knows, Reginald Harris. He tells Harris about the suit he wants to help Drea bring. Harris asks if he is giving him the case, to which James replies, no, he is now an independent attorney, and he’s here to share the case. Harris tells James to find four more families interested in suing, and he’ll take the lead on the case, giving James 40% of the profit.

Courtroom Nick is pleading his case on Josh’s behalf, telling Judge Damsen that Josh has a right to go to the adoption party.
The supervisor of the group home protests, pointing out that Josh has been to nine of them now, and that he has become so upset after the last couple that they have decided he shouldn’t attend any more.
Judge Damsen says that he can go. She then asks Laurie if they have assigned Josh an escort. Laurie starts to say no, but she’ll be happy to escort him, when Judge Damsen speaks up and says “Mr. Fallin, I order you to escort him.”
Nick is clearly thrilled, and asks Laurie what time the thing starts. Josh is overjoyed, and tells Nick it starts at 5, but to be there at 4 because traffic could be bad. The theme for this particular party is a fashion show.

Thanks, Spunky, I'll try it. If the little boy turns him self inside out, I'll be crying my eyes out (if I still have them...)

Yippee. Nick is going to a party. Does he get to wear a party hat?
"clearly thrilled"? A fashion party hey? Then he won't have to go to any effort.

Alvin catches up with Laurie out in the hallway. She tells him that they’ve won, that the boy is going. Right before they part, Laurie asks if Alvin would like to have dinner with her Friday night. He is clearly surprised, and says something like, I thought you didn’t want to move this in a personal direction. Laurie smiles and says, “Well, I changed my mind.”
Conference room at Harris’ office James and Harris are explaining to a group of people who had family members who died at the hospital what their plans are. They tell the families that they need them to tell them as much as they possibly can about their loved ones: about their lives, their children and families, their illnesses, even about their final days.

Courtroom Lulu is before Judge Damsen asking that Jenna be moved to the Olive Branch. She explains that Jenna is currently fifteenth on the waiting list, but because of the seriousness of her condition she should be moved to the head of the list. F&F We see James and Harris arriving at F&F. Nick meets them in the doorway, introduces himself and “my partner, Jake Straka” to Harris. Harris, trying to make chit-chat with Nick says “I’ve met your father—he’s a hell of a tennis player. Do you play?” “No,” replies Nick succinctly. Jake asks James if he is there as an attorney or a client, to which James replies he is there as an attorney.
Nick and Jake have asked them there to make a settlement offer. The hospital is offering $50,000 per plaintiff, and the offer is good for 24 hours.
