Recaps including all the previous characters appearing (Albert Gregg, etc.), the Kiss from Shelter, etc.
LSP Lulu is meeting with a client, Gavin Portinsky. Portinsky’s parents are bringing charges against him for abuse and holding them against their will. He claims they are trying to kick him out of his house.
He explains that he was a bit of a child star in Pittsburgh doing commercials, and that he was in a running shoe commercial that went national. The commercial paid him $18,000, which his parents used as a down payment on the house. He therefore feels the house is his.

As he’s talking about the running shoe ad, he makes the comment, “You’re a runner aren’t you?”
Lulu looks shocked, and says, “Yes, I used to be, how did you know?”<br>

He replies that he’s very observant, and that the last time he was in her office he noticed a picture of her running in a marathon. He says he can even tell her what she was wearing the last time he met with her, and proceeds to do just that. Lulu becomes increasingly uncomfortable, especially when he mentions a silver necklace she had worn, indicating on his throat where it had come on her. Lulu looks shocked. When Portinsky mentions that her husband is named Brian, she is clearly upset. He points out that he can read upside down, and she has “Brian in New Mexico” written across the calendar on her desk. He points out that being observant is what made him a good actor.
Lulu hurries him out, saying she has another client waiting.

Out in the main office, Lulu approaches Alvin, asking if he still has her Department of Justice pen. He asks if she means the black one, and when she says yes, he says no, he doesn’t. She reminds him that he borrowed it earlier to sign for a package, but he tells her he gave it back. With that he goes into his office
Lulu, still upset, turns to James and asks if she can have her stapler back. He tells her that he’s already returned it. Lulu then announces to the office at large that some of her stuff has disappeared from her office. When James asks what objects, she tells him her favorite red sweater, her mother-of-pearl picture frame, and a couple of other items. James suggests she start locking her office door.

Back in Alvin’s office, Alvin is meeting with a client who is explaining that he and his wife were avid bird watchers before she died. After she died and his sight became bad, he started building bird houses to bring the birds to him so he could see them up close. Now the city is trying to force him to take the aviary down.
As he explains his case, Alvin opens a desk drawer, reaches in, and pulls out a pen. It is black, and as he turns it over and looks at it, we see it says “Department of Justice” in gold lettering.

Olsen house Lulu opens the door and enters. As she turns on the light, the phone rings. She picks it up and says hello, but no one answers. As she starts up the stairs, the phone rings again. Again there is no one on the line. As she stands there, the phone rings a third time.
Cut to the credits.

Judge Damsen’s court room Nick is representing a boy named Kyle Plunkett. Kyle is currently in foster care because his mother is hospitalized after being beaten up by her live-in boyfriend. Kyle’s father, her ex-husband, wants custody of Kyle while she is hospitalized. However, she has made sure that he has only supervised visitation with his son. When Judge Damsen asks Kyle if he would like to stay with his father, Kyle is silent, as if scared. Nick, sitting beside him, notices something, looks down, and sees a puddle of urine on the floor where the child has wet himself in fright. He asks for a recess, and Judge Damsen, being observant, rules immediately that Kyle should remain in foster care for the time being.

The Incline Burton is having lunch with a potential client, who works for the city. Burton and the gentleman make an agreement, and the client hands Burton a file.

Fallin & Fallin Partners meeting. All partners are present as Burton enters the room. He announces that he has just met with (didn’t catch name), and that they actually farm out some of the legal work for the city. With this, Jake speaks up, asking if this means they will be representing the City of Pittsburgh. When Burton replies in the affirmative, Jake explains that Nick has been working for six months to land DBH, a land development company which is currently involved in a lawsuit with the city, and that this would be a conflict of interest.
Burton says no, as long as they stay out of the suit involving DBH, there is no conflict of interest and that Jake and Nick should get them to sign a waiver agreeing to this. Nick speaks up and says that he doesn’t think DBH will go for that. Jake agrees, and suggests that all the partners vote on which client to accept. Burton becomes angry and tells Nick and Jake to get their client to sign the waiver.

Burton goes to see Copeland, Alvin’s client with the aviary. He tries to explain to Copeland that the neighbors are complaining about the smell and noise it causes, but Copeland only replies by talking about the noise made by the neighbors. Seeing that he is getting nowhere, Burton leaves.

F&F Nick catches Burton as he returns to the office. Nick says that DBH won’t sign the waiver until they can meet with the three of them (Nick, Jake, and Burton), and that the meeting is set for 3 o’clock tomorrow. Burton agrees to be there.
