Red’s hospital room
Burton goes by to see Red, who mentions that some of the guys from the plant were there earlier. They say that only about 1% of the employees will agree to the deal being offered, that they don’t believe the plant will really close. Burton explains to Red that there is no way to avoid it, that the plant is closing.

LSP
Nick is in his closet at LSP. Alvin comes in and asks if Nick is going back out to Mt. Aire (the hospital). Nick says yes. Alvin asks if Nick can take care of a case, a child just needs to pick up some clothes at his apartment, the social worker will meet them in Mt. Aire. Nick says he can’t he’s got too much right now.

Out in the lobby, Alvin is telling the social worker that he’ll run the boy out to Mt. Aire himself. Nick, on his way out, catches site of the boy. It’s Kenny, and he looks at Nick with that deep, intense stare. Nick stops, asks Alvin if this is the client, to which Alvin replies yes, and says, I’ll take him. The social worker explains that Kenny doesn’t talk, his father died a couple of years ago, and that he’s being kept at the psychiatric hospital at the moment, until they figure out what’s wrong with him.

Kenny’s apartment
Nick unlocks the door, and Kenny rushes in, sits down at the coffee table, and starts spinning his tops. Nick, making small talk, turns on the television. He asks what clothes Kenny wants, but Kenny doesn’t respond. Nick goes into Kenny’s room and puts some clothes in a box. He comes out and asks Kenny if there are any other things, like the toys, that he wants to take. Still no response. As Nick looks around the room, he notices that the light is blinking on the answer machine. On impulse or intuition, Nick listens to the messages.

It’s Kenny’s mother’s boyfriend, Todd. He keeps apologizing for their fight, saying that Kenny is her son, he’s sorry he interfered with how she raises him. He begs her to come back, to move in with him like they had planned, that Kenny’s room is all ready. As Nick listens, the phone rings. As the message starts recording, he hears that it is Todd, and he picks up.

Hospital
Nick and Kenny meet Todd at the hospital. Todd explains that he and Kiersten (Kenny’s mother) had gotten in an argument, and that she and Kenny had been living with him. He also tells Nick that Kenny is autistic.
Nick talks to Todd about taking Kenny. He explains that it would begin with Todd being made Kenny’s foster parent. Nick also explains that he doesn’t think that the accident was Kiersten’s fault, and that they can sue because there was no stop sign. The social worker will be there soon to explain things more thoroughly.

Nick leaves Todd and Kenny. As he rounds the corner, he sees Barbara sitting on a bench. He asks if there’s any news on Lulu. She says no, that they’re changing her bandages right now.
Barbara begins crying, and explains to Nick that she lost the baby. Nick doesn’t say anything, but you can see him sympathizing, and feel his empathy towards Barbara. Barbara is worried because Evan wants a family so badly, and she doesn’t know how he will take the news.

Caroline comes out of Lulu’s room and says she would like to talk to Nick in private. They go to the stairwell, where she explains that Brian’s specialist wants to do surgery and remove a piece of Lulu’s skull to relieve the pressure on her brain. Caroline wants to fight Brian, and asks Nick if she will be able to fight it in court. Nick says yes, but asks why she would want to.

F&F, Nick’s office
Burton, on his way out of the office, stops in to see Nick and asks about Lulu. Nick tells him that she’s still in the coma, that there’s been no change. Burton tells him that Clayton Steel is in liquidation. As he leaves, he tells Nick to stay too late. You can see the concern in Burton’s face.

Jake comes in. He explains to Nick that the state of Pennsylvania has a law that prevents him from finding out about the number of accidents at that intersection through the state. He says Nick will have to find out another way.
