A bar Evan is waiting for Nick. As Nick sits down, Evan offers a beer, but Nick declines. Evan says that he told Barbara about his first wife, about what happened in Kuwait. He also says that Barbara lost the baby and may not be able to have anymore children. Evan is clearly having second thoughts, as he asks Nick what he (Nick) would do if he really, really wanted a family and had just met a great girl who unfortunately isn’t able to have children. Nick doesn’t have an answer.
Evan asks what it is that Nick needs. Nick reminds Evan of his comment about responding to three calls to accidents at that intersection in the past six months. Evan says he remembers. Nick asks if the emergency service’s dispatchers keep records of all the runs they make. When Evan says they do, Nick asks if Evan can find out for him how many accidents there have been at that intersection in the last five years. Evan says no problem.

Hospital Nick returns, only to have Todd tell him that Kiersten passed away 20 minutes ago.
Nick explains that Todd now needs to get an attorney to help him try to get custody of Kenny. When Kenny asks him if he’ll do it, Nick explains that he can’t that there are conflicts. When Kenny asks what they are, Nick tells him that he was in the other car.
Todd is shocked. He asks Nick why he is helping them, then. Nick explains that he thinks that the city of Mt. Aire is responsible for the accident because there should have been a stop sign there.
Todd is still stunned, and says “You were in the other car. So the other woman, she’s your girlfriend?” Nick doesn’t answer, we just see pain in his face. Todd says something like “We’re in similar situations then.”<br>

F&F conference room Nick, Todd, and the attorney for the city of Mt. Aire are present. Nick explains that there have been 12 accidents at that intersection in the past five years. He hands the other attorney a waiver that states that Todd is aware that Nick was in the other car and that he wants Nick to represent Kenny. The city’s attorney says he look the case over at get back to Nick.

F&F, hallway Burton comes up to Nick as he heads back to his office. He wants to know why Nick is suing Mt. Aire. Nick explains that he thinks the city is at fault. Burton then wants to know why Nick won’t hand the case over to another firm, one that is used to handling cases like this. They would get 50% of the fees anyway. Nick asks why Burton is so worried about this, and Burton explains that this will bankrupt Mt. Aire. Nick says no the city’s insurance will pay for it, and points out to Burton that he’s not suing Mt. Aire for his own injuries, but for Kenny’s loss. Burton asks about Lulu, and Nick says that when she’s well enough, she can make her own decision as to whether or not to sue.

Hospital As Nick comes in, Brian explains that Caroline is taking him to court to try to stop them from doing surgery on Lulu. When Nick turns to her, Caroline says to him “What gives you the right to talk to me about this?” and breaks down.

As she runs out into the hall, Nick follows her. She is sobbing, and asks who will love and take care of Lulu after she (Caroline) dies, if Lulu isn’t able to take care of herself. She tells Nick that she can tell how much he cares for Lulu, and that she knows that if he were the one making the decisions he would opt for the surgery. She says that he’s young, and if the surgery failed and Lulu died, he would be able to go on with his life knowing that he did what he could for her.
She explains that as a mother, she would rather see Lulu quiet and peaceful in a coma than to see her die.

F&F, Burton’s office Burton explains to Evan that he thinks the town of Mt. Aire is going to die like so many other steel towns have done, and that he wants to back out of the deal. Evan tells him that he can’t, that the money is already committed. He explains that the day before he bought three storefronts on Main Street for the center, and that the downpayment on them was $40,000.
Burton says that he’ll take a check for $60,000 and they can write off the rest. Evan asks him what’s the deal with $100,000 to him, and Burton replies that it’s a lot of money.
Evan tells Burton that last year when he helped arrange things at Clayton Steel, his father said that Burton was trying to buy the town’s forgiveness. Burton is at a loss for a reply. Evan explains that a non-profit group who is trying to revitalize these old steel towns is willing to talk to him about funding for the rest of the center, and he challenges Burton to stay in.

Courthouse Alvin and Nick are at the shelter hearing for Kenny. Todd is awarded temporary custody. As they leave, Alvin hands Todd a number for a group that will help him when Kenny gets to be too much, and Nick says he’ll see Todd tomorrow at the other meeting. Todd is left standing there with Kenny looking lost and bewildered.

This scene (Nick and Caroline debating the operation) was, for me, amazing to watch. Simon's acting was... outstanding. He had all of 2 lines, yet you knew exactly what Nick was feeling. The man can do more with no dialogue than many can with.
