LSP Evan stops by to see Barbara. He explains that he has to go to Harrisburg to meet with this non-profit group, but that he’ll be back in time for their appointment with the justice of the peace. (The wedding was called because of the accident, and they decided just to go to the justice.)

Hospital Nick, Brian, and Caroline are in the surgery waiting room. Nick is very restless, and starts to pace, until Caroline asks him to stop. Brian is about to get them all coffee when the surgeon comes out. He tells them that the surgery went well and that the pressure is starting to go down a bit. Caroline asks if she can see Lulu, and the doctor tells her that she can look at her through the window, but she can’t actually go into recovery.

Nick and Brian are left standing there as Caroline and the doctor leave. Nick turns to Brian, asks “You still want that coffee?” Brian says no, that he’s going to head back to Columbus, but asks that Nick tell Lulu he was here when she wakes up. Then he reaches out, they shake hands, and part amicably.

F&F Nick and Todd, the attorney for Mt. Aire are meeting with an accident specialist. Taking Kiersten’s injuries into account, the specialist is able to re-create what happened. The specialist explains that the injuries indicate that Kiersten was turned around looking at Kenny in the back seat at the time of the collision. In addition, the damage to the Suburban indicates that Kenny’s seat belt was not buckled, so Kenny would have been free to move around. Not only that, but there is no indication that the Suburban swerved in any way to miss the Passat. From this, they have no choice but to conclude that the accident was caused by Kiersten having to forcibly restrain Kenny. Therefore, the city is not at fault.
Nick tries to get them to explain how Kiersten also suffered a broken right cheek bone in this scenario, but the specialist merely states that this injury did not occur in the accident, but would have been caused by blunt force trauma. Nick, scanning the room as he takes in this news, suddenly notices Todd’s bandaged left hand.

Quickly taking leave of the others, Nick ushers Todd into his office. He confronts Todd, who confesses that in their last fight he struck Kiersten. Nick says he doesn’t know if he thinks Todd can be trusted with Kenny. Todd tries to explain that he struck Kiersten in an argument over the fact that in a fit of exasperation she was lifting Kenny out of his chair by his hair, but Nick is already calling Social Services.

Actually, Skater, I think Brian was in the middle, with Caroline across from Nick. But she was still sort of "between" them.

Courthouse Barbara is waiting outside the justice’s office for Evan. It’s getting close to 4.30, which is when they have their appointment. Nick arrives, saying “I thought you might need a witness or something.” He joins her on the bench and they wait.
