Burton’s Judge’s Chambers Lichtman comes by to tell Burton he met with Agent Calphas. He’s worried, and he needs Burton to find him a lawyer. Burton says no way, he’s staying out of this because of his position. Lichtman says that Calphas wants names and details, and he reminds Burton that he (Lichtman) has audio tapes of Burton and Caldwell talking about Nick’s case. Burton tells him to go ahead and tell Calphas, in fact, tell her right now, and tells his assistant to call her. Lichtman, very agitated, walks out.

Kim’s place Nick and Kim (in bed, of course). Kim tells Nick he has to get ready to go, as Mattie will be home in about ten minutes. Nick says they have plenty of time, and then casually asks “Think you’re ever gonna have dinner with me?” She kind of brushes the question aside, saying of course they’re going to have dinner together. Nick, grinning, continues to bait her with “You can’t continue to treat me like a sexual object. I’m beginning to wonder about your intentions.” She grins back (of course!), and says “How about tonight?”<br>

Fallin and Straka Alvin shows up with the injunction. He tries to serve the injunction to James, who is very definitely giving him the cold shoulder. James points out that he is not the lead on this case, and therefore cannot be served. After a few more spars, it dawns on Alvin that they must be starting the digging right now, and he dashes off.

LSoP Mary Gressler and Shannon are with Lulu in the conference room discussing why Shannon wants to have her mother buried in Pittsburgh. Burton shows up (he’s there for moral support). Mary asks why Lulu has to ask Shannon such painful questions, and Lulu explains that their whole case is based on the emotional plea, therefore, she needs this information from Shannon.

Cemetery Nick is there watching the digging. Alvin shows up with the injunction, so Nick has the workmen stop their digging.
(Nick is dressed in an extremely sharp black or navy blue suit, navy shirt, and navy and silver striped tie, by the way     .)

Why on earth would Nick need to be there? Auditioning for a cameo on Six Foot Under?

Courtroom—hearing over Mandy’s remains Lulu makes her argument and wins. Outside the courtroom, she tells Burton, Mary, and Shannon that they must get a copy of the judge’s order for Mary to take to the morgue. Burton says he’ll wait there with Shannon while they go upstairs to get it.
Shannon, canny creature that she is and wise before her years, tells Burton she knows why he’s been coming around so much, and to back off. She says Mary is fragile, and doesn’t need that kind of attention right now. Burton is clearly nonplussed. Shannon goes on to tell Burton that she doesn’t think Mary is his type.

Kim’s place Nick and Kim in bed, again. She finally confesses to him that she’s afraid that if they actually go out on a date they won’t have anything to talk about. He persuades her otherwise, but only after he states that he doesn’t mind staying at her place and having sex. She says no, they’ll go out.
