The Incline Meanwhile, back at the double date . . . Brian is telling a disgusting doctor story (involving puke). Kim follows with a similar one, and then Nick tells one. Brian starts to tell an even worse one (something about a gynecologist friend . . .), when Lulu stops him, telling him it’s making her sick, and after all, they’ve just eaten.
During the stories, Kim sort of lays her head on Nick’s shoulder, they hold hands, it’s all lovey-dovey, and Lulu is obviously uncomfortable. Brian, fg that he is, asks, “So how long have you two known each other?” Kim tells him they met a week ago in a fender bender. Brian comments that it sounds like something out of a porno movie, which clearly upsets Lulu. Kim says that unfortunately, it rather was like a porno movie, all the while exchanging knowing looks with Nick.

Okay feeling sorry for Burton because he doesn't know much in Nick's younger life... poor Burton *sniff*

With this, Brian pops up with his “Well Nick, isn’t it against the rules (or something like that) for you to be dating a cop?” to which Nick immediately responds with something along the lines of “You know more about illegal dating, Brian.” Lulu catches this little exchange, and is clearly upset by it.
Kim says it’s time that she and Nick leave. As they’re walking out, arm-in-arm, they exchange a bit of banter:
Nick: I think our relationship is about much more than sex. Kim: You’re not sleeping at my place tonight. Nick: Fair enough.
They both grin.

In the next shot we see two pairs of feet near the foot of a bed. The owners seem to be turned away from each other. As the camera pans up, we see Lulu lying on her side, wide awake, in troubled thought.

Courtroom—injunction hearing Alvin is arguing that the temporary injunction should stand. James, now representing the county, argues that it should be vacated. The county wins.
Courthouse hallway, immediately after Judith asks Alvin what they do next. He explains that they’ve lost, there is nothing else to do. Burton comes over to Judith (Alvin has walked away), and apologized to her. He offers to pay for Ellie’s reinterrment anywhere Judith chooses. She tells him that the night before, she and the other families had met with a reporter and told their stories.

Burton’s Judge’s Chambers Tom is telling Burton about how they can beat this problem. He says that if Burton will talk to another reporter right now and tell “his” side of the story—denying everything—the whole thing will blow over. He says Burton must deny knowing the woman, and that he must distance himself from Nick’s problems.
Burton says that he made a mistake a long time ago, and he’s not going to lie about it, and insists that Tom deliver his letter of resignation.

Cemetery We see the disinterment progressing, vaults being lifted out and placed on trucks. Nick is there (in another breath-taking dark suit, shirt, and tie :drool: :drool:), watching.
Cut to another part of the cemetery: Mandy’s funeral We see Mary and Shannon sitting side by side, with one other mourner. Burton stands in the background.
Cut back to the other area: Nick, Alvin, and James are all watching the digging. James turns to Nick and says “Let’s get back to work.”<br>

Well, I don't know that he really chose Nick over the judgeship--there was the whole issue of the dead girlfriend from long ago . . .
But I'd say, yeah, he did choose Nick!

Nick's mistake is being buried in one part of the cemetery while Burton's is being dug up. How ironic.

Back to the funeral: Burton is walking away. Mary and Shannon catch up with him. He tells Shannon bye, and she heads to the car. He and Mary chat for a moment. Mary thanks him for helping them. She kisses his cheek, they say bye, she walks away.
Nick and James are walking away from the digging. Nick sees Burton and walks over to talk to him. Burton tells Nick that he resigned the judgeship. Nick, a bit upset, asks if it was because of him. Burton says that no, it had nothing to do with Nick, but that he has resigned.

Nick asks Burton what he plans to do now. Burton says he would like to go back to work, and had thought about going back to his old firm, or what’s left of it, but he’s not up to that.
Nick looks at him and asks “You wanna work with me?” Burton says he would, maybe on a small scale, say 6-7 clients.
They start to walk away, with Burton telling Nick about the old girlfriend and how he had left her when he went away to college. Nick asks if he regrets it all. Burton says “Regret it? It’s the life I have.”

Gin, I know that the real he did it for his girlfriend etc... but maybe he sort of thought of Nick as well... Hey my mind might just have blown way out of proportion but it doesn't hurt to dream does it?
