I'm just doing my finger flexibility exercises, getting ready to start typing up my summary tonight! I also wanted to get my thread ready, so I can just jump right in as soon as I've seen it!

Testimony
We see “previously on The Guardian” scenes, culminating with Mandy unconscious on the floor.
Episode opens with the 911 operator receiving Nick’s call about Mandy, and we hear the call again in its entirety.
Burton appears at the door, and we see this scene again. Nick slams the door as Burton leaves, and we see Burton walking down the stoop.

Next we see Burton entering his place. He hits play on the answering machine. There is a message from Tom (bald guy who helped him get the judgeship) wanting to meet with him. Next a message from a cousin. Burton returns one of the calls, and after the party answers, we hear Nick’s message start. Burton is immediately attentive to it, but remains on the phone. He gets off as quickly as he can, and we see major pain in his eyes, especially when Nick says “I love you.” As soon as the message is over, he’s out the door and on his way back over to Nick’s.

At Nick’s, he sees them taking someone out to an ambulance. He asks where they are taking “him,” to which the medic replies it’s a her, and tells Burton the name of the hospital. Burton goes up to the door, where he is stopped by a cop. He says he needs to get in to see his son. The cop asks his son’s name. When Burton tells him, he says that “Your son’s been arrested and is down at County.”<br> Cut to the new credits, with nifty new theme song, no pictures of Nick being asked to pee in a cup, etc!

Did the 911 operator hear Nick call out "God" and hang up. Did she hear Burton call out "Son" or whatever.

As we come back, we see Nick seated at a table in a courtroom with an attorney. The words “Preliminary Hearing” flash across the bottom of the screen. Nick’s attorney is speaking, telling how Mandy came to the house, etc. Nick is sitting there looking tortured but gorgeous in his orange jump-suit.
The District Attorney (Assistant DA?) explains their view, and states that cocaine was found in the home, so it is considered a drug delivery.
We see Burton sitting behind Nick, taking everything in.

Yes Spunky, she did. Or at least you hear another voice in the background for a moment, then Nick say "O God" and hang up.

Nick’s attorney asks that Nick be released on his own recognizance, as he owns a home and is not a flight risk. The DA agrees, until a probation officer stands up and states that Judge Handley has requested that Nick be held without bail while they investigate parole violations from his previous drug case. The judge agrees. The court date is scheduled for “the ninth of next month.”

Burton and the defense attorney are talking about meeting with the DA, and Burton wants to be present, despite the fact that the guy says the DA won’t want to deal with Burton there.
Next we see Burton talking to his friend Tom. He tells Tom that he would like to have his swearing-in postponed until Nick can be present, as he wants Nick to put the robe on him (big tradition that a family member do this).

We see James sitting in Burton’s former office at what is now Caldwell and Associates talking to Caldwell (who looks rather comfy in Burton’s chair). He has applied for a job, but Caldwell puts him off and says “we’ll keep talking,” making it clear that he’s not interested in James.
As James leaves, Jake, who is Caldwell’s 3 o’clock appointment, shows up, and they pass outside the door.

We see Nick’s attorney, Burton, and the DA. They are negotiating the terms. If Mandy dies, it will be third degree murder. The DA finally says he won’t go for anything less than two years felony conviction. Burton immediately says no.

We see Burton and the attorney talking with Nick. They tell him what the DA said, and he immediately says no. He would rather wait and see what happens with the probation revocation hearing.
Burton asks to speak to Nick alone, and the attorney leaves the room. Nick immediately tells Burton that he should stay away from this to protect himself. Burton says no, he’s in it, and that Belden (the same attorney from Nick’s drug case), is doing his best, and he’s the one that got Nick off the first time. Nick says “No, you did that.” Nick continues, saying that he won’t take the deal because “I haven’t done anything wrong.”
Burton looks at him as if he can’t decide whether to believe him or not, and tells Nick he’ll bring him a suit, tie, and shoes.
